Article 1 – Definitions In these terms and conditions, the following definitions apply:
- Faralda: Faralda Exploitatie BV, located at NDSM-plein 78, 1033 WB Amsterdam, Chamber of Commerce 58133437.
- Guest: the natural person or legal entity making a request or booking with Faralda.
- Venue: Faralda Crane Hotel, including the studio, suites, elevators, and associated areas.
- Agreement: any arrangement between Faralda and the Guest.
Article 2 – Applicability These terms and conditions apply to all requests, bookings, and agreements with Faralda. The Faralda Manual and any specific event or stakeholder agreements apply in addition. In the event of conflict between documents, the specific agreement prevails over these general terms.
Article 3 – Nature of the Venue Faralda Crane Hotel is a private venue, accessible by invitation only and subject to written approval. Faralda reserves the right to refuse any request or booking without providing reasons.
Article 4 – Requests and Bookings 4.1 A request is non-binding until Faralda confirms it in writing. 4.2 A booking becomes final only after full payment and written confirmation by Faralda. 4.3 Bookings are personal and non-transferable.
Article 5 – Prices and Payment 5.1 All prices exclude VAT, tourist tax, deposits, and any additional costs, unless explicitly stated otherwise. 5.2 Payment is made in advance, unless agreed otherwise in writing. 5.3 For events, an additional deposit applies in accordance with the Faralda Manual.
Article 6 – Cancellation and Modification 6.1 Bookings are non-refundable, non-modifiable, and non-reschedulable, unless agreed otherwise in writing. 6.2 Faralda may cancel or modify a booking in cases of force majeure, unsafe conditions, adverse weather, technical limitations, maintenance, or government measures, without being liable for any direct or indirect damage.
Article 7 – House Rules and Conduct 7.1 The Guest and their invitees must follow instructions from Faralda and its staff. 7.2 Smoking is only permitted in designated areas. Confetti, glitter, duct tape, and similar materials are not permitted. 7.3 Faralda is a national monument. Drilling, mounting, or damaging the structure is strictly prohibited. 7.4 In case of misconduct, disturbance, or failure to comply with house rules, Faralda may deny access without refund.
Article 8 – Liability 8.1 Visiting and staying at the venue is at the Guest’s own risk. 8.2 Faralda is not liable for injury, theft, loss, or damage to property of the Guest or their invitees. 8.3 The Guest is fully liable for any damage caused by themselves or their invitees. 8.4 Faralda is only liable for direct damage resulting from intent or gross negligence, up to a maximum equal to the amount paid by the Guest for the relevant booking.
Article 9 – Photo, Video, and Audio Recordings 9.1 Taking photos, video, or audio recordings at the venue is only permitted with prior written consent from Faralda. 9.2 By entering the venue, the Guest consents to recordings made by Faralda for promotional purposes.
Article 10 – Advertising and Publications Placing logos, banners, promotional materials, or social media content referencing Faralda, the event, or the venue is only permitted with prior written consent from Faralda.
Article 11 – Privacy Our privacy policy applies to all processing of personal data by Faralda.
Article 12 – Governing Law All agreements with Faralda are governed by Dutch law. Disputes are exclusively submitted to the competent court in Amsterdam.
